HOBBS, New Mexico -

A Hobbs man has been arrested accused of beating and sexually assaulting his estranged wife.

On July 25, Lea County Sheriff's Deputies responded to the lea Regional Medical Center in reference to a reported battery.

The victim told officers she had been followed by her estranged husband, Nelson Ponce, 27, while traveling between Lovington and Hobbs. Investigators say there was an active restraining order against Ponce.

Ponce continued following the victim, when deputies say he swerved his vehicle into hers forcing her to come to a stop in a ditch on the side of the road. That's when investigators say Ponce forced her into the front passenger seat of her car.

The victim told investigators she tried opening the door while the car was in motion when he punched her in the face, knocking her unconscious. She told investigators, when she regained consciousness, "her phone charger was wrapped around her neck." When she tried to escape, deputies say Ponce held her in a choke hold.

The victim also told police Ponce forced sexually assaulted her in the backseat of her vehicle. In an attempt to defend herself, she told investigators she remembered grabbing Ponce by the face and scratching him near his mouth.

Deputies observed injuries to Ponce's right hand and left arm, along with a scratch wound on the corner of his mouth consistent with the victim's statement.

Ponce was arrested on July 29 on the following charges: kidnapping, criminal sexual penetration, aggravated battery, aggravated assault, aggravated stalking and interference with communications.

He is being held on a no bond pre-trial detention order.
