LUBBOCK, Texas -

A man appealing his capital murder conviction for hiring a hitman to kill a romantic rival in 2012 is back in jail.

Thomas Dixon was out on bond after the Seventh Court of Appeals over-turned his conviction in December 2018.

Earlier this month, the state's highest criminal court finalized Dixon's conviction for the death of Dr. Joseph Sonnier.

Dixon paid his business partner with about $9,000 in silver bars to kill Sonnier in his home. David Shepard's spending life in prison without parole for the crime.

Dixon's attorney told the Seventh Court of Appeals last week he's appealing the conviction to the U.S. Supreme Court.

He's awaiting word back since the court isn't obligated to take up the case.
