Seventh Court of Criminal Appeals ballots missing in Cochran and Collingsworth County

LUBBOCK, Texas -

Voters in two counties didn't get a chance to vote in a judicial race Tuesday. The Republican race for the Seventh Court of Criminal Appeals wasn't on ballots in Cochran or Collingsworth counties. 

John Schmidt is the Republican Party Chairman for Cochran County. He didn't find out about the error until after noon Wednesday. When he called the state party to report the problem, Schmidt said it claimed full responsibility. 

"There's not anything you can do locally. You have no control over anything outside of your county," Schmidt said. "It makes me disappointed whenever something happens like this and the voters don't have the chance to make that vote."

Larry Doss was behind Steven Denny by 319 votes in the race according to the secretary or state's unofficial count. He plans to do what he says is right. 

"We are meeting with people and trying to determine the best way for those voters to have the opportunity to be heard whether it's for me or my opponent but more importantly, voters have an opportunity to vote the way that they choose," Doss said. 

Doss said he hasn't ruled out filing suit. That's what it takes to force the party to take action, according to the election code. The GOP plans to certify results by the 12th. In a phone call, Denny says he believes he's the winner and says the party doesn't need anything else.
