Defense questions if Fierro knew robbery could end in death

The defense will resume Monday in the trial of a man charged with murder last summer.

Ivan Fierro is on trial for the death of Robert Dendy. Prosecutors claim Fierro took part in an armed burglary at Dendy's neighbor's house and knew it would put someone's life in danger.

 

Another man charged with Dendy's murder, Kyi Baker, testified Friday morning.

Baker said Fierro helped plan the heist. He said Fierro gave his nephew a gun, then left before Baker and Fierro's nephew ransacked the home.

The defense focused on whether Fierro could reasonable assume someone could have been killed. Fierro's attorneys argued he was chased off by someone with a gun and could not have known that Dendy would have confronted the other people accused of the burglary.

If convicted for Dendy's death, Fierro faces up to life in prison with the possibility for parole. 

Baker was also indicted for Dendy's death. He is awaiting trial. Police have not released the name of the 14-year-old they say shot Dendy while he was chasing them.
