Lamesa physician suspended after public intoxication arrest

LUBBOCK, Texas -

The Texas Medical Board temporarily suspended, without notice, a Lamesa physician's license after determining his practice "poses a continuing threat to public welfare".

Dr. Rafael Fermin Garcia was arrested by Lamesa police early last month for public intoxication. 

He was reportedly on-call in the Medical Arts Hospital's Emergency Room at the time of the arrest. Police report Dr. Garcia was "belligerent and walking around in the public area of the emergency room in only his underwear".   

Since the arrest, Dr. Garcia's license has been suspended, but the medical board does not state a reason. 

Dr. Garcia was previously convicted of a DWI that was reported to the Texas State Board of Medical Examiners. 

He's charged with public intoxication and was also booked into jail on an outstanding warrant for criminal mischief out of Ector County.

A temporary suspension hearing with notice will be held as soon as practicable with 10 days' notice to Dr. Garcia, unless the hearing is specifically waived by Dr. Garcia.

The temporary suspension remains in place until the Board takes further action.
