Decision on Reagor-Dykes bankruptcy pushed to March

There is not yet certainty on how the Reagor-Dykes Auto Group will emerge from bankruptcy, though a new settlement involving Vista Bank brought some hope.

During a bankruptcy hearing Wednesday morning, a continuance was granted on the motion to convert the case to Chapter 7 liquidation. This pushes back a decision to a hearing March 24. But Reagor-Dykes counsel expressed confidence a plan to liquidate to emerge from bankruptcy would work, preventing the need to convert to Chapter 7.

Attorneys presented a new liquidation plan, asking for three weeks before a vote to confirm it. Several attorneys told Judge Robert Jones this would not allow enough time to complete needed work. This included counsel for Ford Credit and GM Financial.

Meanwhile, the U.S. Trustee's office and Vista Bank's counsel argued Chapter 7 conversion is needed now, arguing this bankruptcy case has dragged on for too long and unfilled promises.

Judge Jones agreed on the repeated delays, saying the case has carried on since the summer of 2018. He listed the multiple failed attempts to sell or reorganize. But, he also cited the $7.5 million settlement from Vista Bank to be paid to the Reagor-Dykes bankruptcy estate as progress. Judge Jones referenced other bankruptcy cases where there seemed to be no hope, then developments emerge.

The Vista Bank settlement was discussed as the first significant amount of capital coming into this case in a long time.

Also, attorneys provided an update on the many consumers who have dealt with title or other problems since July 2018. More than 1,300 cases have been resolved. There are still 108 consumer issues outstanding.

As we reported Tuesday, the Texas Attorney General's Office opposes liquidation right now because it would likely disrupt the latest efforts to resolve these consumer problems. 

In its filing, the AG's office states the Auto Group has worked diligently to resolve tax, title and license issues. There are still about 100 customers who have not received their titles. And the estate is working on a settlement. The office specifically names Rick Dykes, saying he is close to resolving the last of those cases. The state wants completion of a deal that would have Dykes put up money to fund someone working on behalf of the customers.

 

Ford Credit filed suit against the Reagor-Dykes Auto group and its principals Bart Reagor and Rick Dykes in July 2018, claiming massive fraud. Many Reagor-Dykes companies then filed for bankruptcy, which is this massive case that has been ongoing since.

Following the bankruptcy filing, Ford amended its suit to list Reagor and Dykes individually as defendants. Dykes settled with Ford. A federal judge ruled summary judgment against Reagor. A jury trial later determined the amount Reagor owed. Reagor's request for retrial was denied.

Several former Reagor-Dykes employees have pleaded guilty to federal fraud charges and are awaiting sentencing. There have also been multiple civil actions between banks and other entities tied to the Auto Group. Our list of stories covering the case since 2018 is below.
