UPDATED: Reagor-Dykes claims FirstCapital participated in fraud

In a new court filing in U.S. Bankruptcy Court, attorneys for the Reagor-Dykes bankruptcy estate claim FirstCapital Bank was involved in massive fraud and acted in coordination with former Reagor-Dykes CFO Shane Smith. Smith is awaiting sentencing after pleading guilty to a federal charge of conspiracy to commit wire fraud.

This story was updated Thursday with a response from FirstCapital Bank below.

In the adversary proceeding filing, which is essentially a lawsuit filed within a bankruptcy case, Reagor-Dykes attorneys claim Smith worked "directly with FirstCapital's CEO, Brad Burgess" in fraudulent schemes to defraud "the Debtors and the Debtors' Creditors".

This action is similar to one Reagor-Dykes filed a few weeks ago against Vista Bank. A filing Wednesday morning shows Vista Bank has settled with Reagor-Dykes.

And if claims between these parties sounds familiar, related allegations were leveled in a lawsuit filed by Vista Bank against FirstCapital Bank in 2018, citing a massive check-kiting scheme orchestrated to keep the Auto Group afloat. The lawsuit was settled in November 2019. A joint news release from the banks then stated there was a "mutual and amicable resolution of their dispute". This suit did not include any Auto Group companies or principals or employees as defendants. 

Back to the new filing, Reagor-Dykes attorneys show Reagor Auto Mall's accounts continued to accrue greater overdrafts. "By the end of May 2018, RAM's checking accounts were consistently overdrawn by more than $2 million a day."

Reagor-Dykes claims FirstCapital allowed these checking accounts to not go through the usual banking review processes, it allowed fraud within the Auto Group to continue to grow. From the filing:

"And February 2018 was not an isolated month. FCB’s bank statements reflect that RAM and Amarillo had a negative average ledger balance and a negative average available balance every month from December 2016 through February 2018. Suffice to say, nothing changed in the following months."

The filing cites multiple e-mails between Burgess and Smith. It also claims the funds were merely being moved between different Reagor-Dykes company accounts to "cover the massive, ongoing, multiday overdrafts on the FCB Account Debtor Plaintiff accounts."

Reagor-Dykes wants FirstCapital to turn over property of the bankruptcy estate, to disallow any claims by FirstCapital and to recover damages for what it claims are "willful violations" of the automatic stay.

As for Smith, his sentencing has been delayed. We do not yet have a date for when he or any of the other former employees who have pleaded guilty will be sentenced.

FirstCapital Bank provided a statement to FOX34 Thursday morning:

The lawsuit filed by the Reagor Dykes bankruptcy estate has no merit and is simply an effort to shakedown FirstCapital for a fraud perpetrated by Reagor Dykes and its 12 and counting employees who have already pled guilty to the crimes.

No one at FirstCapital was aware of the fraud underway at Reagor Dykes until learning so in connection with the Reagor Dykes bankruptcy filings. FirstCapital is a victim of Reagor Dykes’ massive fraudulent scheme and nothing more.

Now, the bankrupt shell of Reagor Dykes is suing FirstCapital for failing to tell Reagor Dykes that it was defrauding FirstCapital and many others. Only in a land where up is down and down is up does that make sense.
