Two charged with capital murder after 2-year-old's death

LEVELLAND, Texas -

A Levelland couple is charged with capital murder accused of abusing a two-year-old boy causing his death. 

Mother Samantha Mathis, 25, and boyfriend Robert Garza Jr., 30, were arrested by Levelland police Tuesday after they took the child to the Levelland Covenant Hospital Emergency Room.

Police responded to the hospital to find the child severely bruised on most of his body. After interviews with Mathis and other family members, police determined the child had been assaulted by both the mother and her boyfriend.

Due to the severity of the child's injuries, he was taken to UMC in Lubbock where he later died. 

The Texas Department of Family and Protective Services was called to assist in the investigation. Protective services interviewed the boy's four-year-old brother and learned he had also been abused. He was taken to a Lubbock hospital for treatment.

Additional charges are pending.
