LUBBOCK, Texas -

A man was indicted by a Lubbock grand jury Tuesday, accused of attempting to burn down his girlfriend's duplex where she lived.

Ira Horton, 50, is charged with arson. Lubbock Fire Rescue responded to a structure fire near 38th and Ave. P on January 19.

The victim told police she and Horton had been dating for 6 months and he had been staying with her. She stated that she told Horton she wanted him out of her house. A police report indicates Horton became angry and said "if he couldn't live there, no one could". She told police that Horton had accused her of cheating and threatened to kill her and then himself.

The victim told investigators she left the home to go the laundromat. That's when the victim's sister called and told her the house was on fire.

A witness told police he saw a man that he believed to be the victim's boyfriend walk from the north and enter into the carport. The witness told police he saw Horton leave the duplex 15 minutes before another witness alerted him about the fire.

Horton's held on a $75,000 bond.
