Teen receives 40-year sentence for 2018 shooting

Ruben Arguijo, 17 Ruben Arguijo, 17
LUBBOCK, Texas -

It's a 40-year sentence for a teen who, with another teen and a juvenile, shot and wounded a man outside his southwest Lubbock home last year.

Ruben Arguijo pleaded guilty to aggravated assault with a deadly weapon. He was facing five to 99 years or life in prison, since this crime falls under the "drive-by statute;" that makes the crime a first-degree felony.

Co-defendant Anthony Acosta is also charged in this case.

Investigators say Acosta, 19 at the time, Arguijo, then 17, and a juvenile were burglarizing vehicles near 70th and Winston. This is just outside the Loop, east of Slide Road.

A neighbor, Jeff James, called 911. While on the line, and reportedly against the dispatcher's advice, James went out to confront them. Police say one of the suspects shot James once. His injuries were not reported to be life-threatening at the time of the arrests.
