Diocese of Lubbock appeals to Seventh Court

LUBBOCK, Texas -

The Catholic Diocese of Lubbock is appealing a judge's ruling to the Seventh Court of Appeals in Amarillo.

Former deacon Jesus Guerrero is suing the church for $1 million in damages. He claims it ruined his reputation by falsely placing him on a list of clergy credibly accused of molesting children.

The church asked the court to dismiss the suit because it was following church canon law and Guerrero was accused of assaulting a woman who habitually lacks use of reason.

Judge Les Hatch denied the church's motion to dismiss.
