Lubbock council to review suit claiming excessive force

LUBBOCK, Texas -

On Lubbock City Council's Tuesday agenda for executive session is a lawsuit filed against the city regarding the use of lethal force.

Paul Valderas claims Officer Billy Mitchell unlawfully shot him multiple times during a drug bust in 2017. Valderas is paralyzed from the chest-down. 

Valderas's attorney provided surveillance video.

A judge later ruled the officer cannot be sued.

According to investigators, the drug trafficking suspect pulled a gun and did not listen to demands to drop the weapon. Officer Mitchell then shot him. 

A grand jury declined charges against Officer Mitchell. Mitchell is still a member of the Lubbock Police Department. 

Valderas is awaiting trial for charges of drug dealing and being a felon with a gun.
