The company in charge of the Lubbock County Medical Examiner's office has three days to provide proof of insurance before county commissioners begin considering "remedy options," including terminating its contract early.

Precinct two commissioner Jason Corley raised the issue in open court Tuesday, claiming NAAG Pathology Labs has not provided proof of contract-mandated liability insurance, totaling $2 million.

"I had my sprinkler company come out and make repairs on a part," Corley said during the meeting. "They show up, they've got their insurance -- it's one of the first things we ask for."

Corley said the company hasn't provided a copy of its insurance, and asked how the county can trust it without verifying it.

NAAG Labs has been stymied by legal issues, including lawsuits and an investigation involving the Texas Attorney General's Office, over claims its pathologists improperly conducted autopsies -- including one litigant who claims Dr. Sam Andrews, the Chief Medical Examiner, ordered her child "disassembled" for research purposes. 

Citing "personal or political agendas," Evan Matshes informed County Judge Curtis Parrish his company does not intend to renew its contract with Lubbock County.

In his letter, Matshes claims the agendas against the company have made it "impossible" to recruit new pathologists to help staff the office, and have interfered with its role in the criminal justice system.

The contract is set to expire September 30. If the company does not provide proof of insurance coverage to the county commissioners, County Judge Parrish said the commissioner's court will begin conferring with legal counsel to work out "options" in regard to the company, including potentially terminating that contract early.
