Slow progress reported on Reagor-Dykes customers' TT&L, trade-ins

Slow progress is being made on resolving Reagor-Dykes customers' unpaid tax, title and license and also trade-in balances. There are still hundreds of unresolved cases totaling $5.4 million in owed balances.

An attorney for Reagor-Dykes told the bankruptcy judge Wednesday there are still 737 vehicles with unresolved TT&L. This current balance is about $1 million.

There are also 195 instances of unpaid trade-in liens, totaling $4.3 million.

The attorney said when the chief restructuring officer took over daily operations of the Auto Group, his team discovered 781 TT&L issues totaling $1.4 million and 221 instances of unpaid trade-ins, totaling $4.8 million. Further investigation identified 333 additional TT&L issues valued at $421,000, and eight more trade-in problems, totaling $261,000.

The attorney said progress has not been fast enough for all parties involved, including consumers. She said resolution has been constrained by Reagor-Dykes' available time, money and personnel.

Reagor-Dykes' legal team has requested lenders pay TT&L and trade-ins to bring these issues to a close. TD Auto was the first lender to reach such an agreement. A Reagor-Dykes attorney said discussions are ongoing with several of the lenders, trying to resolve customers' issues as quickly as possible.

One potential solution that may prove faster is an agreement between the new investor group that's emerged to restructure the Auto Group and retail lenders. As we reported a few weeks ago, the group is led by Lubbock developer Marc McDougal, Fin Ewing, who operates auto dealerships in North Texas, and one of the existing principals Rick Dykes.

According to a Reagor-Dykes attorney, this potential solution would require retail lenders to pay off TT&L and trade-ins, with the investor group reimbursing the lenders. This agreement would also ask the lenders to provide lending to the restructured company in the future. But this was merely presented to the judge Wednesday as a possibility.

At a hearing Nov. 29, a Reagor-Dykes attorney explained the "global solution" that would constitute the company restructuring. Approval has not been granted to this plan. 

Attorneys for various lenders expressed frustration during Wednesday's hearing at a lack of information being provided by the chief restructuring officer's team regarding titles and vehicles. One attorney said, after 4.5 months, they should be able to get at least basic information to resolve their customers' issues.

Most other items on the Wednesday docket related to the Reagor-Dykes bankruptcy cases were passed to later dates in January or February.
