Clovis man sentenced for sexual contact with a minor

CLOVIS, New Mexico -

Ninth Judicial District Attorney, Andrea Reeb, announced that on September 26, 2018, David Garcia, age 46, of Clovis, was sentenced to the maximum of six years in prison.

On August 22, 2018, a Curry County jury found Garcia guilty of Criminal Sexual Contact of a Minor under the age of 13, a third degree felony. The incident occurred at David Garcia’s home, in October of 2014, where the victim was spending the night.  The victim disclosed what had happened to her grandmother in January of 2015. 

The Honorable Drew Tatum presided over the one-day trial and sentencing today.  Judge Tatum stated that he had a great deal of sympathy for the victim in this case and it is a tragedy that people in positions of authority commit crimes against the most innocent of our society, children. Tatum ordered that in addition to the prison time, Garcia register as a lifetime sex offender registration, serve 5-20 years on probation and 5 years to life on parole.  

Brian Scott Stover, Chief Deputy District Attorney, and Kristen Beltran, Assistant District Attorney prosecuted the case for the State.  Jonathan Miller, Criminal Defense Attorney, of Albuquerque, represented Garcia.
