Defendant confesses to drunk driving, indicted on intoxication assault charge

LUBBOCK, Texas -

The Lubbock grand jury indicted a defendant who confessed to drunk driving and seriously injuring another driver, according to court records.

Evan Simmons III was indicted on an intoxication assault charge with serious bodily injury.

Prosecutors said Simmons rear-ended a vehicle near 4th Street and Toledo Avenue back in February.

Court records show Simmons openly confessed to police he was drunk and struck the victim's vehicle and even refused sobriety tests. Simmons reportedly told police "I'm not going to lie to you. I was intoxicated while driving."

Terry Norris, 66, was rushed to the hospital due to the crash with serious injuries.
