Republican Party files formal petition to remove constable following DWI arrest in May

Posted: Updated:
LUBBOCK COUNTY, Texas -

Update 6/4

The Lubbock County Republican Party, led by County Chairman Steve Evans, has filed a formal petition to remove C.J. Peterson from office.

According to the petition, removal of office requires a jury trial.

Lubbock Police reported Peterson's blood alcohol content to be .152 percent, nearly twice the legal limit of .08 percent on the early morning of May 6.

Investigators report Peterson blew through the intersection near 50th and Belmont, then struck a couple of parked vehicles at the King David Trails apartments. No one was hurt.

Due to the high BAC, charges against the constable were upgraded May 30 from a Class B misdemeanor DWI, to a Class A misdemeanor DWI with a BAC of more than 0.15.

Original Story 5/25/18

Republicans in Lubbock are taking steps to have a county constable removed from his position.

A statement released by the Lubbock County Republican Party reveals executive committee members voted unanimously to authorize party chair Steve Evans initiate removal proceedings in district court for Lubbock County Precinct 4 Constable C.J. Peterson. He was arrested earlier this month for a DWI. He's been allowed to remain constable, and is on personal leave right now.

Investigators report Peterson blew through the intersection near 50th and Belmont, then struck a couple of parked vehicles at the King David Trails apartments. No one was hurt. Officers say Peterson failed a field sobriety test.

This is Constable Peterson's second verified DWI charge. Another one back in 2010, led to him resigning as a Hockley County Sheriff's Deputy. He was elected to his current post back in 2015, running as a Republican. His party is waiting to take action until results of his blood test are in.

Peterson was told about the vote ahead of time, and given the opportunity to speak, but he didn't show up. The law allows any county resident to initiate removal proceedings for some county officers in district court for  incompetency, official misconduct, or intoxication on or off duty.
